Project One: FM -- Terms of Service.

By accessing, viewing, downloading or otherwise using the Project One: FM Website or any webpage or feature available through Project One: FM website or www.projectone.fm, any information provided as part of our services, or any related emails, newsletters, or services (hereinafter collectively referred to as "Services"), you conclude a legally binding agreement with Project One: FM

If you are using Project One: Fm on behalf of a company or other legal entity, such entity may have a separate agreement with us, but you are nevertheless individually bound by this Agreement.

Terms of Use:

1. You must comply with all applicable laws (whether federal or local);

2. You must not transmit any worms, viruses, or any other codes of a destructive nature through Project One: FM;
3. You must not transmit unwanted email or advertisements (Spam) to any Project One: FM member(s);
4. You must not modify, adapt, or hack Project One: FM;

5. You must not associate Project One: FM with any other website, organization, or event without prior written approval;
6. You are solely responsible for any action that occurs on your account. This includes but is not limited to submissions, comments, or posts made while using Project One: FM;

7. You must keep your password confidential;

8. You recognize that Project One: FM may have to report illegal activity to the appropriate law enforcement authorities;

General Conditions:

1. Project One: FM reserves the right to modify or terminate the Service for any reason without notice.

2. Project One: FM reserves the right to alter the Agreement at any time. If the alterations constitute a material chance to the Agreement, then Project One: FM will notify you via the email you provided. Continued use of Project One: FM will constitute your acknowledgment and agreement to the changes.

3. Project One: FM reserves the right to refuse service to anyone for any reason at any time.

4. Project One: FM reserves the right to remove content that is unlawful, offensive, threatening, libelous, defamatory, obscene, or otherwise objectionable or violates any party's intellectual property or in violation of the Agreement, as determined by Project One: FM.

5. Project One: FM reserves the right to coordinate with the appropriate legal authorities in conjunction with any illegal activity that may have occurred while using Project One: FM.

6) You understand that all postings, messages, text, files, images, photos, video, sounds, or other materials ("Content") posted on, transmitted through, or linked from Project One: FM, are the sole responsibility of the person from whom such Content originated. More specifically, you are entirely responsible for each individual item ("Item") of Content that you post, email or otherwise make available via Project One: FM. You understand that Project One: FM does not control, and is not responsible for Content made available On the site, and that by using the site, you may be exposed to Content that is offensive, indecent, inaccurate, misleading, or otherwise objectionable. Furthermore, the Project One: FM site and Content available may contain links to other websites, which are completely independent of Project One: FM. Project One: FM makes no representation or warranty as to the accuracy, completeness or authenticity of the information contained in any such site. Your linking to any other websites is at your own risk. You agree that you must evaluate, and bear all risks associated with, the use of any Content, that you may not rely on said Content, and that under no circumstances will Project One: FM be liable in any way for any Content or for any loss or damage of any kind incurred as a result of the use of any Content posted, emailed or otherwise made available on the site. You acknowledge that Project One: FM does not pre-screen or approve its members nor content, but that Project One: FM shall have the right (but not the obligation) in its sole discretion to refuse, delete or move any Content that is available via on the site, for violating this TOS or for any other reason.

7. You agree not to post the following content, while using the Project One FM Chat Room:

a) that is unlawful, harmful, threatening, abusive, harassing, defamatory, libelous, invasive of another's privacy, or is harmful to minors in any way;
b) that is pornographic or depicts a human being engaged in actual sexual conduct ;
c) that harasses, degrades, intimidates or is hateful toward an individual or group of individuals on the basis of religion, gender, sexual orientation, race, ethnicity, age, or disability;
d) that impersonates any person or entity, including, but not limited to, a Project One: FM employee, or falsely states or otherwise misrepresents your affiliation with a person or entity (this provision does not apply to Content that constitutes lawful non-deceptive parody of public figures.);
e) that includes personal or identifying information about another person without that person's explicit consent;
f) that is false, deceptive, misleading, deceitful, misinformative, or constitutes "bait and switch";
g) that infringes any patent, trademark, trade secret, copyright or other proprietary rights of any party, or Content that you do not have a right to make available under any law or under contractual or fiduciary relationships;
h) that constitutes or contains "affiliate marketing," "link referral code," "junk mail," "spam," "chain letters," "pyramid schemes," or unsolicited commercial advertisement;
i) that advertises any illegal service or the sale of any items the sale of which is prohibited or restricted by any applicable law, including without limitation items the sale of which is prohibited or regulated by California law;
j) that contains software viruses or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer software or hardware or telecommunications equipment;
k) that disrupts the normal flow of dialogue with an excessive amount of Content (flooding attack) to the Service, or that otherwise negatively affects other users' ability to use the Service; or
l) "stalk" or otherwise harass anyone;
m) collect personal data about other users for commercial or unlawful purposes;
n) use automated means, including spiders, robots, crawlers, data mining tools, or the like to download data from the Service - unless expressly permitted by Project One: FM;
o) attempt to gain unauthorized access to Project One: FM's computer systems or engage in any activity that disrupts, diminishes the quality of, interferes with the performance of, or impairs the functionality of, the Service or the Project One: FM website; or
p) use any form of automated device or computer program that allows the creations of accounts, reporting of accounts, adding of friends, sending of messages, posting of bulletins, comments, blogs, or forum posts without each being manually entered by the author thereof (an "automated device").

Consequences for Violation:

Violation of any part of this Agreement will result in termination of your Project One: FM account as well as being reported to the authorities if deemed necessary appropriate.
